Agreement
By accessing or using getconsent.io ("Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms from time to time; the "Last updated" date above will change when we do.
Description of the Service
getconsent.io provides cloud software that helps you display and manage cookie and similar consent experiences on your websites, including configuration, hosting of the consent widget, and related analytics and account features. Features and limits depend on your plan.
Your account
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate registration and billing information. You must promptly notify us if you suspect unauthorized access.
Acceptable use
You agree not to misuse the Service. Without limitation, you must not:
- Use the Service to violate applicable law, including privacy, consumer protection, or data protection laws.
- Use the Service to misrepresent consent, deceive end users, or circumvent legal requirements for valid consent or transparency.
- Attempt to probe, scan, or test the vulnerability of our systems, or interfere with the Service or other users.
- Reverse engineer or attempt to extract source code except where mandatory law allows.
Service availability
We use commercially reasonable efforts to keep the Service available. The Service may be interrupted for maintenance, security, or reasons outside our control. We do not guarantee uninterrupted or error-free operation and do not offer a service level agreement (SLA) unless expressly agreed in a separate written contract for your organization.
Intellectual property
We and our licensors own all rights in the Service, including software, branding, and documentation. Subject to these terms and your plan, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes and to embed the widget on sites you control. You retain ownership of your own content and configuration choices.
Limitation of liability
To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the fullest extent permitted by applicable law, we and our suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, goodwill, or business opportunities, arising from or related to your use of the Service, even if we have been advised of the possibility of such damages.
Our aggregate liability for claims arising out of or related to the Service in any twelve-month period is limited to the greater of (a) the fees you paid us for the Service in that period or (b) one hundred euros (€100), except where mandatory law (for example under EU consumer rules) does not allow such a cap.
Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence or fraud.
Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these terms, if required by law, or if we discontinue the Service with reasonable notice where practicable. Provisions that by their nature should survive (including intellectual property, limitation of liability, and governing law) will survive termination.
Changes to these terms
We may modify these terms by posting an updated version on this page. Material changes may be communicated by email or in-product notice where appropriate. Continued use after the effective date constitutes acceptance of the updated terms, except where applicable law requires your explicit consent.
Governing law
These terms are governed by the laws of the Netherlands, without regard to conflict-of-law principles, except that if you are a consumer habitually resident in the European Union, you may also benefit from mandatory protections of the law of your country of residence. Courts in the Netherlands have non-exclusive jurisdiction, subject to any mandatory venue rules for consumers.
